Association Committee in Trade Configuration

The Ukraine – EU Association Committee in Trade Configuration (АСТС)  is set up in accordance with Article 465 (4) of the EU-Ukraine Association Agreement to consider issues related to the Title IV "Trade and Trade-Related Matters" of the Association Agreement.

The ACTC acts in accordance with the Rules of Procedure approved by the Ukraine – EU Association Council Decision No. 1/2014 of 15 December 2014 adopting its Rules of Procedure and those of the Association Committee and of Subcommittees.

Meetings of the ACTC are held annually, with representatives from Ukraine and the European Commission.

The first meeting of the ACTC was held in Kyiv, April 12-13, 2016. The event discussed in detail the initial stage of implementation of the Deep and Comprehensive Free Trade Area and the current issues of cooperation between the parties in the trade sphere.

On September 28-29, 2017, the second meeting of the ACTC was held in Brussels.

The third meeting of the ACTC was held in Kyiv 22 on November 23, 2018.

On November 18-19, 2019, the fourth meeting of the ACTC was held in Brussels.

The fifth meeting of the ACTC was held online on December 8-9, 2020.

The following decisions have been adopted by the ACTC:

Decision No 1/2018 of the EU-Ukraine Association Committee in Trade Configuration of 14 May 2018 updating Annex XXI to Chapter 8 on Public Procurement of Title IV — Trade and Trade-Related Matters of the Association Agreement and giving a favourable opinion regarding the comprehensive roadmap on public procurement

Decision No 2/2018 of the EU-Ukraine Association Committee in Trade Configuration of 14 May 2018 on recalculating the schedule of export duty elimination and safeguard measures for export duties set set out in Annexes I-C and I-D to Chapter 1 of Title IV of the Association Agreement 

Decision No 1/2019 of the EU-Ukraine Association Committee in Trade Configuration of 25 March 2019 on the establishment of the list of arbitrators referred to in Article 323(1) of the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Ukraine, of the other part

The following Sub-Committees operate within the ACTC:

  • Trade and Sustainable Development Sub-Committee

The TSD Sub-Committee has been established under Article 300 of the Association Agreement to address the issues covered by Chapter 13 "Trade and Sustainable Development" of Title IV of the Agreement.

On May 30, 2017, the first meeting of the Sub-Committee was held in Brussels, at which the Rules of Procedure were approved

The second meeting of the Sub-Committee was held in Kyiv on November 13, 2018.

On November 6, 2019, the third meeting of the Sub-Committee was held in Brussels.

The fourth meeting of the Sub-Committee was held online on October 27, 2020.

  • Sanitary and Phytosanitary Management Sub-Committee

The SPS Sub-Committee has been established under Article 74 of the Association Agreement to address the issues covered by Chapter 4 "Sanitary and Phytosanitary Measures" of Title IV of the Agreement.

On May 16, 2017, the first meeting of the Sub-Committee was held in Kyiv, at which the Rules of Procedure were approved

On November 20, 2017, the second meeting of the Subcommittee was held. The third meeting of the Subcommittee was held in Kyiv on November 16, 2018.

On November 18, 2019, the fourth meeting of the Sub-Committee was held in Brussels. During the meeting, the parties signed the Decision of the Sub-Committee on the modifying Annex V to Chapter 4 of the Association Agreement

Decision No 1/2019 of the EU-Ukraine Sanitary and Phytosanitary Management Sub-committee of 18 November 2019 modifying Annex V to Chapter 4 of the Association Agreement

The fifth meeting of the Sub-Committee was held online on November 8-9, 2020.

  • Customs Sub-Committee

The Customs Sub-Committee has been established under Article 83 of the Association Agreement  to address the issues covered by Chapter 5 "Customs and Trade Facilitation" of Title IV of the Agreement.

On June 15, 2017, the first meeting of the Sub-Committee was held in Kyiv, at which the Rules of Procedure were approved

On July 2, 2018, the second meeting of the Sub-Committee was held in Brussels.

The third meeting of the Sub-Committee was held on July 11, 2019 in Kyiv.

The fourth meeting of the Sub-Committee was held on September 23, 2020.

In 2018, the Sub-Committee adopted the Decision that replacing Protocol I to the Ukraine-EU Association Agreement

Decision No 1/2018 of the EU-Ukraine Customs Sub-Committee of 21 November 2018 replacing Protocol I to the EU-Ukraine Association Agreement, concerning the definition of the concept of ‘originating products’ and methods of administrative cooperation 

  • Sub-Committee on Geographical indications

The GI Sub-Committee has been established under Article 211 of the Association Agreement to address the issues of cooperation in the field of protection and security of geographical indications.

On May 18, 2017, the first meeting of the Sub-Committee was held in Kyiv, at which the Rules of Procedure were approved

On June 12, 2018, the second meeting of the Sub-Committee was held in Brussels.

The third meeting of the Sub-Committee was held in Kyiv on May 15, 2019.

The fourth meeting of the Sub-Committee was held online on November 9, 2020.

The provisions of Title IV of the Association Agreement also provide for the functioning of the Dialogue on intellectual property issues ("IP Dialogue").

The Dialogue shall operate in accordance with Article 252 (3) of the Association Agreement to address the issues of intellectual property rights protection, in particular those covered by Chapter 9 "Intellectual Property" of Title IV of the Agreement.

Meetings of the IP Dialogue were held in Kyiv on June 6, 2017, June 19, 2018 and June 26, 2019, and November 18, 2020 by videoconference.
